These variations do not permit us to deliver a product that is materially different from its description.

Customers are responsible for reviewing the available size guide and selecting the preferred size before placing an order.
Sizing and fit may vary depending on:

• Heel height;
• Material;
• Personal fit preference;
• Manufacturer measurements.
Size guidance is provided to assist customers but cannot guarantee an identical fit for every person.
If Altessa Maison sends a size different from the size ordered, or if the product materially differs from the published size information, the matter will be handled as an incorrect or non-conforming product.
Returns caused solely by the customer selecting an unsuitable size are governed by our Return and Refund Policy.
9. PRODUCT AVAILABILITY
All orders are subject to product availability.
Adding a product to a shopping cart does not reserve the product.
We may establish reasonable quantity limits per:

• Household;
• Order;
• Payment method;
• Delivery address;

• Promotion.
If a product becomes unavailable after an order is placed, we will contact the customer and offer an appropriate solution, which may include:

We will not substitute a product without the customer’s consent.

Depending on the customer’s location, prices may be displayed or converted through Shopify Markets or another currency conversion service.
The price displayed during checkout before the customer submits the order is the price applicable to that order, subject to the correction of an obvious error as described in these Terms.
Currency conversion rates may change over time.
The customer’s bank, card issuer or payment provider may apply:
• Currency conversion charges;
• International transaction charges;
• Bank fees;
• Other third-party charges.
These third-party charges are not controlled by Altessa Maison.
Where required, applicable taxes, shipping charges and other costs collected by Altessa Maison will be disclosed before the customer submits the order.
11. TAXES, DUTIES AND IMPORT CHARGES
Depending on the delivery destination, an order may be subject to:

Where Altessa Maison collects applicable taxes or duties during checkout, the amount will be displayed before the customer submits the order.
Where an order is shipped without duties or import charges being prepaid, the destination country may require the customer to pay those charges before or upon delivery.
Any customer responsibility for import charges must be disclosed during checkout, in the Shipping Policy or through another clear pre-purchase notice.
Charges imposed directly by customs authorities, governments, postal operators, carriers or other third parties are not controlled by Altessa Maison.
Customers are responsible for providing accurate information required for customs clearance.
Nothing in this section permits Altessa Maison to impose undisclosed mandatory charges after an order has been submitted.
12. PROMOTIONS AND DISCOUNTS
From time to time, Altessa Maison may offer:

Unless otherwise stated, promotional codes cannot be combined.
Promotional offers have no cash value and cannot be exchanged for cash.

• Applied because of a clear technical error.
Returns involving bundles, free gifts or multi-product discounts may result in the promotional value being recalculated according to the conditions disclosed at the time of purchase and our Return and Refund Policy.
Any recalculation will not restrict rights that cannot legally be excluded.
13. PLACING AN ORDER

An automated order acknowledgment confirms that we received the order. It does not necessarily confirm that the order has been accepted.

Unless mandatory law provides otherwise, an order is accepted and the sales contract is formed when we:

We will not refuse orders unlawfully or on the basis of a protected personal characteristic.
16. PRICING OR DESCRIPTION ERRORS
Despite reasonable efforts, a product may occasionally be listed with an obvious pricing, currency, availability or description error.
If an obvious error is identified before order acceptance, we may:
• Correct the information;
• Contact the customer;
• Offer the customer the opportunity to place the order using the corrected information;
• Cancel the order.
If an error is identified after acceptance, we will contact the customer and handle the issue in accordance with applicable law.
We will not charge a higher price than the amount accepted by the customer without the customer’s express agreement.
If the customer does not agree to a proposed correction, the affected product may be cancelled and refunded.
17. PAYMENT
Available payment methods are displayed during checkout.
Payments may be processed by Shopify Payments or another payment provider.
By submitting payment information, the customer confirms that:
• The information is accurate;
• The customer is authorised to use the payment method;
• The payment provider may process the transaction;
• The total amount shown at checkout may be charged.
Payment providers may perform:

• Payment authentication;
• Fraud screening;
• Security checks;
• Address verification;
• Card authorisation.
Altessa Maison does not normally receive or store complete card numbers or card security codes.
If payment is declined, reversed, disputed or not authorised, we may suspend fulfilment or cancel the affected order.
The customer remains responsible for amounts validly due under an accepted order, subject to the customer’s legal rights.
18. BILLING AND ORDER INFORMATION
Customers must provide current, complete and accurate billing, delivery and contact information.
The customer must promptly notify us if relevant information changes before fulfilment.
Altessa Maison is not responsible for avoidable delivery delays caused by incorrect or incomplete information supplied by the customer.
However, we will make reasonable efforts to assist with address corrections where the order has not yet been dispatched.
Changing an address after dispatch may not be possible and may result in carrier charges or delivery delays.
19. FRAUD PREVENTION
We and our payment or technology providers may conduct checks designed to prevent:

• Account compromise;
• Chargeback abuse;

An order may be delayed while additional information is reviewed.

21. DELIVERY AND TRANSFER OF RISK
For purchases made by consumers, responsibility for accidental loss or damage normally transfers to the customer when the customer, or a third party designated by the customer, physically receives the product, except where applicable law provides otherwise.
Delivery may be completed when the parcel is:
• Delivered to the customer;
• Delivered to a person authorised by the customer;
• Delivered to a designated safe place with the customer’s authorisation;
• Collected from an agreed collection point;
• Otherwise delivered according to the customer’s approved instructions.
If a customer appoints a carrier that was not offered by Altessa Maison, different risk-transfer rules may apply where permitted by law.
22. LOST, DAMAGED OR DELAYED PARCELS
Customers should contact us if tracking shows an unexplained delay, loss or delivery problem.
We may request information needed to investigate the matter with the carrier.
Customers should not be required to resolve a carrier claim alone where Altessa Maison remains legally responsible for delivery.
Where an order is confirmed as lost before legal delivery, we will provide an appropriate remedy, which may include:
• Replacement;
• Reshipment;
• Refund.
Where tracking shows delivery but the customer cannot locate the parcel, the customer should:
• Check the delivery location;
• Check with household members;
• Check with neighbours where appropriate;
• Check any safe-place notice;
• Contact the carrier;
• Contact Altessa Maison promptly.
We will assess the available evidence and the customer’s applicable legal rights.
23. RETURNS, WITHDRAWALS AND REFUNDS
Returns, withdrawals, cancellations and refunds are governed by our Return and Refund Policy:

Altessa Maison offers a voluntary 30-day return period for eligible products, subject to the conditions stated in that policy.
Customers in the European Union and other applicable jurisdictions may also have mandatory cancellation, withdrawal or return rights.

Refunds will normally be issued to the original payment method.
Payment providers may require additional time to display a processed refund in the customer’s account.
24. EUROPEAN UNION RIGHT OF WITHDRAWAL
Consumers in the European Union generally have the right to withdraw from an eligible distance purchase within 14 calendar days after delivery, without providing a reason.

Normal wear, accidental damage, misuse, unauthorised alteration or failure to follow reasonable care instructions may not constitute a product defect.

44. GOVERNING LAW
These Terms and contracts concluded through our website are governed by the laws of Portugal.
However, this choice of law does not deprive a consumer of mandatory protections available under the laws of the country where the consumer habitually resides, where those protections apply.
Nothing in these Terms requires a consumer to waive a right that cannot legally be waived.
45. JURISDICTION AND DISPUTES

The remaining provisions will continue in effect.
Where a provision cannot be interpreted or limited, it will be treated as removed without affecting the validity of the remaining Terms.
47. NO WAIVER

A waiver is effective only where clearly communicated and legally valid.
A waiver relating to one event does not automatically apply to another event.
